Company legal terms
EPF & ESI Easy File ("the Service") is software provided by SMS E SOLUTIONS ("we", "us", "our"), a proprietorship of Milind Kumar, GSTIN 29BFKPM9576H1ZL, registered at Shop No 9C, Noor Ul Complex, Opp Govt Press, MSK Mill Road, Kalaburagi, Karnataka 585102, India. By creating an account or making a payment you agree to these Terms & Conditions.
Your account
You are responsible for keeping your password safe and for everything done under your account. Tell us at once if you believe someone else has access. You must give accurate registration and billing information.
What the software does
The Service helps you read attendance, calculate wages and produce statutory outputs. It is a tool. The figures you file and the payments you make to any authority or employee remain your responsibility.
No statutory advice
Nothing in the Service is legal, tax or statutory advice. Statutory rates are configurable and each carries a verification status. You are responsible for confirming that the rates and formats in use are correct for your establishment before filing.
No government affiliation
This is independent software. It is not affiliated with, endorsed by, approved by, or certified by EPFO, ESIC, GSTN, or any government body.
Subscriptions & payment
Subscriptions run for the term you buy. Prices are shown on the pricing page and are inclusive of GST unless stated otherwise. A subscription is activated only after our server has confirmed the payment with the payment gateway (Cashfree or Paytm). We never store your full card, UPI or bank details.
Intellectual property
All software, source code, design, text, logos and the "EPF & ESI Easy File" and "SMS E SOLUTIONS" names are our property or licensed to us. You are granted a non-exclusive, non-transferable right to use the Service for your own business during your subscription. You may not copy, resell, sublicense, reverse-engineer or create a derivative product from it. The business data you enter remains yours.
Acceptable use
Do not use the Service to break the law, to upload data you have no right to process, to attack or overload the system, or to attempt to access another customer's data.
Termination
You may stop using the Service and close your account at any time by contacting us. We may suspend or terminate an account that breaches these terms, misuses the Service, or charges back a legitimate payment; where practical we will give notice and a chance to fix the problem. On termination your right to use the Service ends; we retain records we are legally required to keep and will, on request, provide an export of your data for a reasonable period.
Availability
We aim to keep the Service available but do not guarantee uninterrupted access. Planned maintenance is notified where practical.
Limitation of liability
To the maximum extent permitted by law, the Service is provided "as is"; we are not liable for indirect or consequential loss, loss of profit, or loss arising from figures you filed or payments you made; and our total liability for any claim is limited to the amount you paid us for the subscription term in which the claim arose.
Governing law
These terms are governed by the laws of India. The courts at Kalaburagi, Karnataka have exclusive jurisdiction, subject to any right you have under consumer law to approach the courts where you reside.
Changes
We may update these terms. The "last updated" date below shows the current version. Continued use after a change means you accept the updated terms.
